Force Majeure Neither party shall be held to be in breach of its obligations under the Agreement, save for obligations to make payments under the Agreement, to the other party for any loss or damage which may be suffered by the other party due to any cause beyond the reasonable control of the first party including but not limited to any act of God, inclement weather failure or shortage of power supplies, flood, drought, virus, lightning or fire, strike, lock-out, trade dispute or labour disturbance, act or omission of Government authorities, other telecommunications providers, war, military operations or riot.

CMS, and websites provided by 24Synergy or partner company. All our sites come with a CMS system that allows you the facility to edit your own details in some cases, once you log in for the first time we can no longer be held responsible for any of the content on your website as any damage done could have been done by yourself, please ensure you are fully aware with how the website functions and the CMS before you begin to make changes which could damage your website and a fee could be charged to fix this. We can assist with repairing any minor issues but reserve the right to charge at any time.
Bad Language and Abuse.
Anyone found to be abusive towards our staff or threatening in anyway will result in the immediate suspension of their account and any outstanding payments will be due immediately. we shall not tolerate verbal abuse towards staff, or the company and it will be at our discretion at what level we feel crosses this line and also if we consider legal action for the same.

Membership Accounts
Users can sign up to memberships on https://24synergy.com. By signing up and paying the user agrees to pay the setup fee and monthly subscription fee on time.
The user agrees to maintain the account and their listings to a high standard with any errors being removed and all mages must be clear and copyright free. We cannot be held responsible for any images posted by user that they do not have the rights to use and once notified we shall remove them immediately.
24Synergy can not be held liable for any email content of any format that is sent by any member of the site, if anything is found to be offensive in anyway the user will be banned and if required their information passed to the law to take further if deemed necessary.
Any customers who enquire for a charter through any of our websites, their details will sent direct to the yacht owner and to 24Synergy at the same time. This customer will always remain the customer of 24Synergy and the yacht owner or fleet operator may only contact them to discuss their current charter booking, they cannot market to the client or store their email for future marketing.
Should a user terminate their account with 24Synergy on any of our sites, then the user agrees that they will no longer contact any of the customers who have made enquires, or booked with them while they were a 24Synergy member. We shall take legal action against any company that breaches this rule.
Members must not add their contact details in their listings in any format and all listings should remain as white label unbranded listings unless you have prior agreement to do so.
If a payment is missed for any reason, we shall notify you for payment and you will have 7 days to respond, if the account is not brought back into credit within 14 days your account will be suspended, after 30 days your listings will be deleted and the account closed.
If you wish to close your account you can cancel at any time, there would be no refunds.
Setup fees are payable when you setup your account.
All users listing yachts on any of our sister web sites agree that they will pay us a commission on sales, this is an agreed commission and we shall produce a separate contract to this effect, commission would normally be in the region of 10-20%
Failure to pay a commission that is due could result in your account being terminated and legal action to collect the funds.
While we shall try and maintain a normal usual uptime of 99.9% with our website, however we cannot be held responsible for technical issues that may result in downtime on the website, during this period there will be no refunds for loss of service unless this extended over a 72 hour period, this also applies to emails.
Recipients and publishers signing up the site accept that the site was only launched on the 14/8/24 and at this time in its infancy and therefore it be a short period of tie before we have gathered an acceptable amount of both recipients and publishers, to compensate for this all accounts will be discounted for a period to give people time to set up there accounts, however it would not be a valid reason to cancel an account during this period, although it is at the site owners discretion.
We have a three strike policy, first offence you will be advised, second offence you will be officially warned and third offence you will receive either a minimum 12 month ban or a life ban.
Payments:
Payments will be taken by Alf The Mailman Ltd and processed through Stripe.
Broker Commissions:
If you join as a broker you will maintain the commissions structure that is in place through normal brokerage sales for a another broker introducing a client.
If you receive an enquiry from a client who is part of another brokers group on 24Synergy then you will be expected to pay normal commissions and at least a 2% finder’s fee from the final sale cost and this will be payable within 14 days of receiving your brokerage payment fee.
24Synergy agree that we shall market the clients listings in a professional manner and by becoming a member the user grants us permission to market their listings on our social media, other websites in the group and external websites that are appropriate, plus any traditional external marketing such as press and magazines. This will be subject to your final approval to adjust if required.
You are not permitted to pass client details to any third parties at any time, or use them in any way even if you terminate your account, this would be a serious violation of their privacy.
Hyperlinking to our Content
The following organizations may link to our Website without prior written approval:
- Government agencies.
- Members with permission
- Search engines;
- News organisations;
- Online directory distributors may link to our website in the same manner as they hyperlink to the Websites of other listed businesses; and
- System wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.
These organizations may link to our home page, to publications or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site.

No use of 24Synergy's logo or other artwork will be allowed for linking absent a trademark license agreement.
Free Accounts V Paid Premium Accounts
During the start up period of 24Synergy while it is in its infancy some features of the Premium paid accounts will be available to access from the free subscriptions. We reserved the right to move these features/lists back into a premium account at anytime and visa versa.
Also certain areas of the site will not be available in the early days of the site until we have gather a suffficient amount of users, this is because they would probably confuse people and it is the numbers that make it work. As such certain areas of the site will not be accesible from day one of the site opening to the public which is the 13th of Sept 2024.
Premium accounts are non-refundable once you sign in to use your account for the first time, but you can cancel on a monthly basis even if you pay quarterly. Use the ticket system if you wish to cancel and revert to a free account.
Subscription Accounts and Mailing Lists
As a member of 24Synergy you will have access to subscribe to and receive information via emails of which are subscription based. While we shall do our best to ensure that publishers only send content that is acceptable within the guidelines provided we can not be held responsible or liable for any information that is sent out by publishers and or the content of any of the emails. This includes any copyright infringements where the publisher should ensure that they have permission to use any copyrighted images or content. Any such breaches of this should be taken up directly with the publisher.
Recipients agree that by subscribing to posts that 24Synergy is not responsible or liable in any way for any of the emails that they may receive except when sent directly to them by 24Synergy.
In the case of Stealth emails, 24Synergy will provide the publishers name to the required parties/authority if there is notification of a copyright breach, or an offence has been committed.
Publishers will receive a warning followed by a 12 month ban or permanent ban if they do not adhere to the guidelines of what type of content can be sent out in each particular mailing list, this will be strictly enforced as it is the main feature of 24Synergy the users do not receive unwanted and undesired content.
No offensive material or political views should be sent using the 24Synergy website, this includes pornographic material or other banned material in any particular country. It is the recipients duty to ensure that they are allowed to receive specific types of material in the country where they reside and also the publishers duty not to publish material in a country where they reside where such material or content is not allowed by Law, 24Synergy can not be held responsible for any breach of country laws by users or recipients who flout the rules or they are ignorant of the law.
No emails should contain images of children or animals that could be considered offensive.
Missed payments will result in your account being closed permanently, once an account has been closed due to a default or breach of terms it is not possible for a publisher or recipient to re-open that account. Suspended accounts can be re-opened at the discretion of 24Synergy.
24Synergy will operate as much as possible a democratic website, however, should any decisions that we feel may be detrimental to the success of the business can be over ruled by the owners of the YB website.
24Synergy aims to operate on a 99.9% website uptime, however should the site go down for any reason due to technical issues ,hacking or DDOS attacks, 24Synergy will not be responsible or liable for any data losses inconvenience or financial losses incurred by any members of the site. There would be no refunds provided and 24Synergy will work as quickly as possible to resume normal operations as soon as possible.
All of the above also applies to any posts made on te website public forums and chat facilities plus posts on your wall in the social section. Any member who’s offensive to any other members, trolls or abuses any other member will be banned permanently. 24Synergy operates on providing assistance & support for fellow members who post on the site, maybe seeking advice or help, it is not a place like Facebook for expressing your opinions so please refrain from any negative comments or becoming a keyboard warrior as this will not be tolerated.
24Synergy is for high end luxury products and HNWI and UHNWI clients, publishers will be expected to keep all emails/posts on topic and not lower the expected tone or high standards expected by the 24Synergy website

Content Liability
We shall not be held responsible for any content that appears on yours or our Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libellous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Hacked and/Or Compromised sites
Unless a specific arrangement has been made with 24Synergy to take daily backups of your website or some form of extra protection, the ownness is on the website owner to look after their website, if a site is infected it will be removed from our server and not replaced until such time you can guarantee that all infected files have been removed and the website is 100% safe.
Unfortunately, 24Synergy cannot guarantee the safety or security of ours or any website, nor is it the fault if 24Synergy as we lock down our servers to the full extent available. If your website has been hacked or compromised at any time, any costs incurred in resolving the issue will be due to the website owner. In current times Hackers do tend to target more high-profile websites but small sites can be compromised in an attempt to use these smaller websites to attack larger website is DDOS attacks.
With CMS systems also, we can only rely on their security measures to keep websites secure and therefore if your CMS is compromised the above still applies that it is the duty of the owner to look after security of the site and any work required to be carried out by 24Synergy will be subject to costs at the owner’s expense.
Any sites that are compromised will be removed from our systems with immediate effect regardless of the affect that it may have on your business as we have to also think about other websites that may be sharing the same server. 24Synergy cannot be held liable in any way for hacked or compromised websites.
Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our website, you agree to be bound to and follow these linking terms and conditions.
Removal of links from our website
If you find any link on our website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links, but we are not obligated to or so or to respond to you directly.
